1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of Willowmere's website at willowesesa.live and the residential care services we provide at our facility located at 78/1 Soi Ari, Phahonyothin Road, Samsen Nai, Phaya Thai, Bangkok 10400.

By accessing our website, contacting us for information, scheduling consultations, or arranging services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

These Terms should be read alongside our Privacy Policy and Cookie Policy, which are incorporated by reference.

2. Definitions

"We," "Us," "Our" refers to Willowmere, the residential care facility operator.

"You," "Your" refers to the person accessing our website or services, including potential residents, current residents, family members, legal representatives, and website visitors.

"Services" refers to companion care, heritage and social activities programming, premier residential living, and related offerings described on our website and in service agreements.

"Resident" refers to individuals receiving care services at our facility.

"Agreement" refers to the service contract entered into between Willowmere and service recipients or their legal representatives.

3. Service Description

Willowmere provides residential care services for seniors, including companion support, cultural and social activities, accommodations, meals, and related assistance. Services are described in detail on our website and specified in individual service agreements.

We operate as a residential care facility rather than a medical care provider. While we observe resident wellbeing and coordinate with healthcare providers when appropriate, we do not provide medical treatment, nursing services, or specialized medical care on-site.

Service offerings, pricing, and availability are subject to change. Information on our website represents current offerings but may be updated without prior notice.

4. Eligibility and Assessment

Our services are designed for seniors who can benefit from residential support and companionship but do not require constant medical supervision or specialized medical care. We conduct an assessment process during initial consultations to determine whether our services align with individual needs.

We reserve the right to decline service or discontinue services if we determine that a resident's needs exceed our care capabilities or if safety concerns arise that cannot be adequately addressed within our service model.

Residents or their legal representatives must have the capacity to enter into service agreements or provide appropriate legal authorization.

5. Service Agreements and Payment Terms

Services are provided according to individual service agreements that specify the scope, duration, and cost of services. These agreements must be signed before services commence.

Payment is due monthly in advance on the first day of each service month. Accepted payment methods include bank transfer and cash payment at our facility. Payments are in Thai Baht (฿).

Late payment may result in service interruption after a notice period. Outstanding balances accrue interest at the legal rate permitted under Thai law.

Pricing adjustments may occur with reasonable notice, typically provided at least 60 days in advance for current service recipients.

6. Service Modifications and Cancellations

Service recipients or their representatives may request modifications to service levels or companion assignments at any time. We will work to accommodate reasonable requests subject to availability and operational capacity.

Either party may terminate services with 30 days written notice. In cases of immediate safety concerns or inability to provide appropriate care, we reserve the right to discontinue services with shorter notice while working to facilitate alternative arrangements.

Deposits or advance payments are generally non-refundable except in cases where we cannot fulfill agreed-upon services due to facility closure or similar circumstances.

7. Resident Responsibilities

Residents and their families are expected to provide accurate information about health history, preferences, and needs that may affect care delivery. Changes in health status or care requirements should be communicated promptly.

Residents are expected to treat staff, other residents, and visitors with respect. Behavior that threatens safety or wellbeing of others, including violence, harassment, or significant disruption, may result in service termination.

Personal belongings brought to the facility are the responsibility of residents and their families. While we take reasonable precautions, we are not liable for loss, damage, or theft of personal property except in cases of our gross negligence.

8. Limitation of Liability

We provide services with reasonable care and skill. However, we cannot control all circumstances and outcomes. Our liability is limited to the maximum extent permitted by Thai law.

We are not liable for indirect, incidental, or consequential damages arising from service provision. Our total liability for any claims shall not exceed the amount paid for services during the three months preceding the event giving rise to the claim.

We maintain appropriate insurance coverage for our operations but are not responsible for events beyond our reasonable control, including natural disasters, pandemics, government actions, or other force majeure events.

This limitation of liability does not apply in cases of willful misconduct or gross negligence on our part.

9. Medical Disclaimer

Willowmere is not a medical facility and does not provide medical diagnosis, treatment, or nursing services. Staff may assist with medication reminders as a courtesy but are not qualified to administer medications or provide medical advice.

We coordinate with external healthcare providers when residents require medical attention but are not responsible for medical care quality provided by third parties.

Residents and their families remain responsible for arranging appropriate medical care, maintaining health insurance, and making healthcare decisions.

10. Privacy and Confidentiality

We handle personal information according to our Privacy Policy and applicable Thai data protection laws. By using our services, you consent to our collection, use, and sharing of information as described in our Privacy Policy.

We maintain confidentiality of resident information except when disclosure is authorized by residents or their legal representatives, required by law, or necessary to protect safety.

11. Intellectual Property

Content on our website, including text, images, logos, and design elements, is owned by Willowmere or used with permission. You may view and print content for personal, non-commercial use but may not reproduce, distribute, or create derivative works without our written permission.

The Willowmere name and logo are our trademarks and may not be used without authorization.

12. Website Use

Our website is provided for informational purposes. While we strive for accuracy, we do not warrant that information is always current, complete, or error-free.

You agree not to use the website for any unlawful purpose, to transmit harmful code or materials, to interfere with website operation, or to collect user information without authorization.

We reserve the right to modify, suspend, or discontinue any aspect of the website without notice.

The remaining provisions shall continue in full force and effect.

17. Changes to Terms

We may update these Terms periodically to reflect changes in our practices, services, or legal requirements. Updated Terms will be posted on our website with a new Effective Date.

Significant changes affecting current service recipients will be communicated through written notice. Continued use of services after Terms updates indicates acceptance of the revised Terms.
